National investment loss lawyers KlaymanToskes reports that broker/investment advisor Christopher John Carpenter a/k/a Chris Carpenter (CRD# 6601132) has been permanently barred from acting as a broker by FINRA (“Financial Industry Regulatory Authority”). Carpenter allegedly failed to provide the regulator with investigation-related information related to its investigation of his prior firm’s allegations of unapproved real estate investments with customers.

According to FINRA BrokerCheck, Christopher John Carpenter was previously licensed with LPL Financial from 2020 to 2023 and with Spire Securities from 2017 to 2020 in Charlotte, NC. He was also previously registered with Janney Montgomery Scott LLC in Purchase, NY.

Chris J. Carpenter Barred for Violating FINRA Rule 8210

On May 18, 2023, FINRA’s Department of Enforcement entered into a Letter of Acceptance, Waiver, and Consent (“AWC”) with Christopher John Carpenter, disclosing that he consented to sanctions of a permanent bar from associating with any FINRA member in all capacities.

According to the AWC, “On February 1, 2023, LPL filed a Uniform Termination Notice for Securities Industry Registration (Form U5), reporting Carpenter’s discharge. The Form U5 stated that LPL was reviewing Carpenter’s ‘alleged participation in unapproved real estate investments with customers.’” The matter originated from FINRA’s review of the Form U5 filed by LPL Financial. 

Pursuant to FINRA Rule 8210, on March 28, 2023, FINRA sent a request to Carpenter for the production of information and documents related to its investigation. In his counsel’s email to FINRA on May 4, 2023, Carpenter acknowledged that he received FINRA’s request and would not produce the information or documents requested. By refusing to produce the information or documents as requested pursuant to FINRA Rule 8210, Carpenter violated FINRA Rules 8210 and 2010. 

FINRA’s Provision of Information and Testimony (Rule 8210)

Under FINRA Rule 8210, all brokerage firms and registered financial professionals are required to provide information, documents, and testimony upon regulators’ requests. 

A violation of FINRA Rule 8210 is also a violation of FINRA Rule 2010, which requires brokerage firms and their registered representatives to “observe high standards of commercial honor and just and equitable principles of trade.”
