National investment loss lawyers KlaymanToskes is investigating investment advisor Kurt Berry (CRD# 4550773) of Regulus Advisors, Vanderbilt Securities and First Advisors National, who has been suspended from acting as a broker by the Financial Industry Regulatory Authority (“FINRA”), following allegations that he participated in private securities transactions involving oil & gas investments, and involving several customers, while associated with Regulus Financial Group and Vanderbilt Securities. 

Financial advisor Kurt Berry is currently facing a pending customer complaint which alleges $473,000 in investor damages due to representations that Resolute/Petrorock Oil & Energy Investments were a non-correlated alternative to the stock market, which would not experience volatility. 

The customer complaint further alleges that the representative “touted the so-called tax benefits of investing in oil and gas securities structured like the Resolute/Petrorock Investments” and “never balanced the presentation with a discussion of risk sand down played the boiler plate disclosure language that appeared in the offering documents as mandatory disclosure language that would have no application.”

According to FINRA’s findings, Berry’s customers invested $517,410 in oil and gas wells through a series of securities offerings. These customers were reportedly all either pre-existing clients or family members of existing clients of Berry’s advisory firm. 

According to FINRA BrokerCheck, investment advisor Kurt Berry a/k/a Kurt Allen Berry was previously registered as a broker with Vanderbilt Securities from November 2019 to July 2022, when the firm filed a Uniform Termination Notice for Securities Industry Registration (“Form U5”) terminating his registration. On November 16, 2023, Vanderbilt Securities reportedly amended Berry’s Form US to disclose that four former customers had filed a statement of claim concerning Berry. Berry is currently registered as an investment advisor with First Advisors National in Johnson City, TN.
