On August 11, 2025, the U.S. Securities and Exchange Commission instituted administrative and cease-and-desist proceedings against Tony Barouti for violations of Regulation Best Interest in connection with his recommendations of GWG Holdings “L Bonds” to 10 retail customers between June 30, 2020, and April 12, 2021.
The SEC found that Barouti willfully failed to exercise reasonable diligence, care, and skill to determine whether the recommendations were in the best interest of each customer, thereby violating both the Care Obligation and General Obligation under Regulation Best Interest. Without admitting or denying the findings, Barouti submitted an Offer of Settlement, which the Commission accepted. As part of the resolution, Barouti was ordered to cease and desist, censured, and required to pay a $50,000 civil penalty, $50,140 in disgorgement, and $12,501 in additional monetary penalties.
