National investment loss lawyers KlaymanToskes is investigating broker Matthew Mierzycki (CRD# 6102769) of Edward Jones and Ameriprise Financial Services, who has been suspended from acting as a broker by the Financial Industry Regulatory Authority (“FINRA”), following allegations that he exercised discretionary trading authority to effect over 500 trades in numerous customer accounts without first obtaining the prior written authorization of the customers.
Edwards Jones’ written supervisory procedures (WSPs) prohibited registered representatives from exercising discretion in a customer’s brokerage account. FINRA found that between December 31, 2020 and October 28, 2021, Mierzycki exercised discretionary trading authority when he executed at least 500 securities transactions in multiple customer accounts without speaking to or otherwise communicating with the customers on the days of the trades. The customers did not provide Mierzycki with prior written authorization for his use of discretion and Edward Jones did not approve the accounts as discretionary accounts.
According to FINRA’s findings, while associated with Edward Jones, Mierzycki also allegedly failed to timely disclose three compromises with creditors on his Form U4. When Mierzycki became associated with Ameriprise, he failed to disclose one of the same compromises with a creditor.
