The broker’s comment listed on the disclosure states: “Claimants cherry-pick and investment that, due to COVID, has not performed as anticipated; however, of note, the security is still viable and no final determination with regard to further distributions to clients (if any) has been made by the entity. Therefore, claimed damages are speculative at best and do not take into account dividends paid, other investments or the performance of the portfolio overall. Also, there is no merit to the claim that they were not aware of the risk of the investment as there are numerous signed documents that outlined the specific risk liquid nature of the investment they now complain about. The statement of claim does not provide and proof to support the allegations and the Firms Initial investigation has not revealed evidence thereof. Therefore, the intends to defend the claim as without merit.”
