Brandon Hanna: $10 Million Options Complaint  

According to FINRA BrokerCheck, Brandon Hanna has three customer complaints. The most recent complaint is pending and alleges $10,000,000 in damages to the customer’s account due to unsuitable options investments. The complaint also alleges elder abuse, breach of fiduciary duty, professional negligence, negligent misrepresentation, and  securities fraud in violation of the Kansas Securities Act.

Hanna has two additional customer complaints, including one complaint which alleged $15,000,000 in damages due to unsuitable options investments. The customer received an arbitration award of $4,762,653 and further alleged negligence, misrepresentation, breach of contract, violation of the California Securities Act, violation of the California Business & Professions Code, and Violation of the Kansas Securities Act.

A third customer complaint alleged $1,188,816 in damages due to unsuitable options investments and further alleged breach of fiduciary duty, constructive fraud, fraud by misrepresentation and omission, and Negligence. The customer was awarded $1,593,119.50 by a FINRA Arbitration panel. 

What is Regulation Best Interest (“Reg BI”)? 

SEC Regulation Best Interest, a/k/a “Reg BI” establishes a “best interest” standard of conduct for brokers and brokerage firms making recommendations of securities investments and investment strategies to their customers, under the Securities Exchange Act of 1934. 

Investment advisors and their firms have a responsibility to make recommendations with their customer’s best interest in mind, based upon the client’s personal needs and preferences. 

Additionally, a representative that recommends investments for the purpose of being compensated through increased commissions, and enriches themselves rather than properly benefiting the client, is violating securities laws
