National investment loss lawyers KlaymanToskes is investigating barred broker Anthony Diaz (CRD# 4131948) of IBN Financial Services, following the law firm’s filing of a customer complaint with the Financial Industry Regulatory Authority (“FINRA”) (Claim No. 24-02488), alleging investor damages of up to $500,000 due to unsuitable recommendations to invest in iCap private placements and Bakken Drilling Fund III LP.

According to FINRA BrokerCheck, broker Anthony Diaz was previously registered with IBN Financial Services from September 2012 to April 2015 in Scotrun, PA. Diaz was permanently barred from acting as a broker by the Financial Industry Regulatory Authority (“FINRA”) in May 2015, in connection with findings that he engaged in misconduct in connection with the sale of direct participation partnerships and real estate investment trusts, and induced approximately eighty customers to enter into variable annuity exchanges, often subject to significant surrender charges, without a reasonable basis for recommending those exchanges.

Anthony Diaz was charged in May of 2016 by the U.S. Attorney’s Office for having devised a scheme and artifice to defraud and obtain money and property by means of materially false and fraudulent pretenses, representations and promises in the sale of alternative investments. Diaz was found guilty of failing to explain to clients that the investments lacked liquidity and that there was no public market for resale. In 2020, Diaz was found guilty on 11 counts of criminal fraud.

Signs Investors Should Look Out For About Their Brokerage Accounts

As an investor, there are a few signs that you should look out for if you believe you may have a claim against your financial advisor. These signs could potentially indicate misconduct, negligence, or investment fraud. Investors are encouraged to contact our firm immediately if you have experienced any of the following:

  • You have substantial losses in your investment accounts
  • You received a call, email, or other communication from your broker’s supervisor or manager regarding your portfolio
  • Your broker misrepresented investment opportunities, or failed to disclose details about investments
  • You notice unauthorized transactions in your investment accounts
  • Your broker is not returning your calls or emails
  • You filed a complaint with your brokerage firm that has not been resolved

Some investors have close relationships with their brokers due to the time and trust built over the course of their investment relationship. However, it is crucial to remember that financial decisions should be based on careful analysis and due diligence rather than solely relying on personal relationships.

According to FINRA and the SEC, investment firms such as IBN Financial Services are responsible for the supervision of all of the activities of their registered brokers/investment advisors. Investors may be entitled to a financial recovery if their firm failed to supervise the representative managing their account, and/or if their financial advisor made unsuitable investment recommendations.
